About the role
Senior Litigation Lawyer – Surety and Trade Credit. Partner with Claims and Underwriting to manage complex disputes and protect Intact’s recovery position.
Responsibilities
Join a specialized, high‑performing legal team within Intact's Legal Affairs.
Manage volume of complex surety (bond claims) and trade credit (subrogation) files, developing risk‑based prioritization strategies.
Analyze and structure matters involving securities (PPSA, movable hypothecs, assignment of receivables), secured creditors, subordination agreements and priority disputes.
Represent Intact before all levels of court (Superior Court of Justice, Ontario Court of Appeal, administrative tribunals) as well as in mediation and arbitration.
Intervene in insolvency, restructuring or arrangement proceedings (CCAA/BIA), interfacing with trustees, monitors, secured creditors and financial institutions.
Advise and support underwriting teams in preliminary legal analysis of complex files (indemnity agreements, performance bonds, payment bonds, guarantees, subordination agreements, etc.).
Provide rigorous legal opinions to claims teams on liability, subrogation, validity of securities and recovery strategies.
Lead multi‑party negotiations (clients, financial institutions, trustees, third parties) achieving favorable outcomes for Intact.
Protect Intact's recovery assets through appropriate remedies.
Contribute to development and updating of standard forms according to provincial practices.
Prepare and deliver internal training sessions for underwriting and claims teams on specialized topics.
Qualifications
Bachelor of Laws (LL.B. or J.D.) and in good standing with the Law Society of Ontario.
Membership in a bar of one of the Atlantic provinces is an asset; remote work permitted, occasional travel required.
More than 10 years of relevant experience.
Strong skills and expertise in complex civil litigation, particularly in surety law, trade credit, securities and recovery, construction, drafting, research and analysis, negotiation and all stages of litigation including trial.
Strong knowledge of securities law (PPSA), insolvency (CCAA/BIA) and commercial contract law.
Experience with Ontario’s Construction Act (construction liens, construction bonds) highly valued.
Strong sense of responsibility, dynamism, team spirit and influential leadership.
Ability and interest in mentoring and developing less experienced resources.
Willingness to travel across Ontario and Canada, occasionally as needed.
Bilingualism (English and French) is an asset.
Compensation
Salary range: 161,600 - 197,500. Annual bonus target 15% with potential payout up to double the target, based on base salary, personal and company performance.
